Terms and Conditions
1. APPLICATION FOR ENROLLMENT.
You may apply for enrollment in the iHotelBay Membership or Sponsorship Program offered by iHotelBay.com, by submitting a completed enrollment application online. Submitting your application indicates your agreement with and acceptance of these Terms and Conditions, as may be amended from time to time by iHB in its sole discretion. iHB may amend these Terms and Conditions, at any time, by posting the amendments on iHB's company website, www.iHotelBay.com. All amendments to these Terms and Conditions shall automatically be effective upon the effective date specified in the posting or, if no effective date is specified, 30 calendar days after they are posted on www.iHotelBay.com. The only way to become a member of iHB is via emailing the complete detail about the client business and paying appropriate membership fee via email only. We now accept website payment via PayPal. We may send you email invoice and you can pay fees using your credit card or PayPal account. SEND US YOUR CONTENT (Pictures, Description and other Details) ONLY VIA EMAIL: icontent@ihotelbay.com
2. MEMBERSHIP STATUS.
Your Certification by iHB as a Client. You will become an active Client immediately upon (i) iHB's certification of you as a Client of the Program ("Membership"), and (ii) iHB's receipt and collection of your Membership Fees. iHB's certification may include the classification of Membership. If your Membership is not certified, iHB will refund your Membership Fees. Membership status will continue according to the membership program. Client can become member for 1 year. iHB membership program is subjected to auto payment via PayPal to renew the membership or sponsorship. If Client can not pay membership/sponsorship fee for 30 days after the due date, membership/sponsorship will be cancelled. All clients are recommended to pay their membership/sponsorship renewal fee fifteen days (15 days) prior to the expiration date of their membership. Contact iHB With Questions About Your Membership. 3. MEMBERSHIP DUTIES AND OPPORTUNITIES.
As an active member or sponsor you should provide current and future events about your business. You can submit your offers, deals, discount coupons, updates directly via email so we can update your listing accordingly. All information provided must be submitted by responsible business individuals only. Responsible members include staff members, owner, managers and/or business agent mentioned by business owner.
4. PAYMENT METHODS.
iHotelBay is using only one payment method currently. Clients wanting to stay active member should pay their fees prior to their membership expiration. iHB recommend that client should pay membership renewal fee at least fifteen days (15 days) prior to the membership expiration. Membership fee will be collected in advance for the entire period of membership. We do not sell email address so the email is the only way to communicate with us regarding to payment and other matters.
The ONLY Payment method:
All clients must pay their fees via emailed invoice if they are not enrolled in auto-payment program via PayPal. We will send you email invoice that will have a payment amount and link to pay that bill. Client must pay via email invoice method and all payments must go to info@ihotelbay.com via PayPal. We are NOT accepting any checks, drafts, and money orders. After paying your fee you must notify iHotalBay.com about your payment via email: info@ihotelbay.com or ibusiness@ihotelbay.com
5. TERMINATION, CANCELLATION OR EXPIRATION OF YOUR MEMBERSHIP.
a. Termination of Your Membership. In the event that you fail to comply with any of these Terms and Conditions iHB may immediately terminate your Membership. If your Membership is terminated by iHB for any reason, you will not be entitled to any refund of payments or Membership Fees, and any balances owed to iHB. In the case where such a third party reseller enrolled you and collected your Membership Fees, you agree that all refunds shall be paid to you from such third party reseller. iHB reserves the right to cancel any membership at any time for any reason in its sole discretion.
b. Cancellation of Your Membership. You may cancel your Membership by notifying iHB via email ibusiness@ihotelbay.com. You can cancel your membership within thirty days (30 days) of your membership started and iHotelBay will cancel your membership. One can cancel the membership only if he/she is enrolled under our Gold Pack and Platinum Pack membership program. Once you cancel your membership with iHB we will issue your refund after 60 days of cancellation. We will only refund your membership fee for the remaining period of your membership, refund also depends on the type of your membership. Any processing fees, activation fees and/or shipping fees (if any) are non-refundable. No refund will be issued if you are enrolled under our Startup pack and Silver Pack.
A cancellation agreement may also be sent to you to sign and return via email only. Once we agree your cancellation, you will be no longer active client of iHotelBay.com. To become a client again you have to pay a membership fee again in advance. iHotelBay agrees to stop future billings after your cancellation request, but you may receive automatic email regarding to payment. If you receive any email after your cancellation or termination, please notify ibusiness@ihotelbay.com about the issue and team will remove your name from the automatic emailing system. One can not legally challenge any automatic email after membership termination, those emails can be cease by just sending a notification email to ibusiness@ihotelbay.com explaining your issue. Fail to meet all of these requirements for cancellation, your Membership will remain Active and all future billings as agreed upon at enrollment will be resumed. At this point, you will be obligated to fulfill the terms of your contract. Membership made via any special offer/promotion are cancellable during the membership period but are non-refundable. Client can only refuse to pay future fees. No refund will be issued for any client want to cancel the membership thirty days (30 days) prior the membership expiration date.
Providing all cancellation requirements described in this section have been met within the cancellation period provided, a refund will be issued less any applicable activation, shipping (if any), processing, and/or application fees that may have been charged at the time of enrollment. Activation, shipping (if any), processing, and/or application fees are non-refundable. NOTE: Faxed, or Mailed requests for cancellation will not be processed by iHotelBay. You agree that submitting a request for cancellation using these methods will be considered an invalid request. The only method to file a request for cancellation is sending an email to ibusiness@ihotelbay.com
c. Cancellation of Your Renewal Membership. Unless you elect not to renew your Membership by notifying iHB via email, at least thirty (30) days prior to the expiration of your Membership, or iHB elects not to renew your Membership at least thirty (30) days prior to the expiration of your Membership, your Membership will be automatically renewed for additional terms of the same duration of time as on the initial application, subject to payment and collection of the applicable Renewal Fee(s).
6. PROMOTIONAL MATERIALS, DEALS AND COUPONS.
iHB may (i) ask you to provide some promotional materials, (ii) ask you to provide support services including coupons or vouchers, and (iii) ask you to use your trademarks or tag lines to promote your business. Business owner has all rights to provide or not to provide the Promotional Materials, Deals and Coupons to us. We will consider all promotions offered by business on their own business website and will add it on our website on behalf of active client according to the type of the membership. We will only count all your written correspondence (emails) and all verbal communications with an iHotelBay representative to represent any promotional material on iHotelBay.com
7. MARKETING.
Quality Standards and Rules for the CAN-SPAM Act of 2003. The Senate and House of Representatives of the United States of America in Congress assembled, and have implemented an Act known as the CANSPAM Act of 2003 The purpose of this Act is to provide recipients means of protection against unsolicited commercial electronic mail. The receipt of unsolicited commercial electronic mail may result in costs to recipients who cannot refuse to accept such mail and who incur costs for the storage of such mail, or for the time spent accessing, reviewing, and discarding such mail, or for both. Pursuant to the CAN-SPAM Act of 2003, when engaging in electronic mail marketing of your or iHB services, you agree that all commercial electronic mail sent by you as a client of iHB shall include: (i) a full physical address of iHB, (ii) a valid telephone contact number for yourself or iHB, (iii) a valid return email address so that the recipient can easily communicate with you, and (iv) a header or subject line that is not false or misleading in any way. In addition, you acknowledge and agree that any request to remove the recipient's email address must be honored within ten (10) days of the date you receive the request. Any electronic mail campaign should be submitted to info@iHotelBay.com electronic mail address prior to being delivered to any clients or prospects for approval by iHB. The CAN-SPAM Act of 2003 and this procedure will be available at iHotelBay office for your review.
Any email from iHotelBay.com is not spam and recipient can request back to remove oneself from our email database. One will only receive an email if he/she ever participate electronically in any of our email promotion via ihotelbay.com or any of our partner website.
Quality Standards and Rules for the National Do Not Call Registry. In compliance with federal, state, county and local laws, iHB maintains the National Do Not Call Registry in iHB's system.
8. LIMITATION OF LIABILITY
NOTWITHSTANDING ANYTHING CONTAINED IN THESE TERMS AND CONDITIONS, IN NO EVENT WILL iHB OR ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND/OR REPRESENTATIVES BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR SPECIAL DAMAGES, LOST DATA, DELAYS, LOST PROFITS, LOSS OF REVENUE OR ANY OTHER ECONOMIC LOSS, COST OR EXPENSE ARISING FROM OR RELATED TO THESE TERMS AND CONDITIONS, WHETHER ARISING OUT OF CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY IN TORT OR OTHERWISE, EVEN IF iHB OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL iHB BE LIABLE FOR ANY TYPE OF LOSS TO YOU CAUSED BY AN EVENT BEYOND ITS CONTROL, INCLUDING, BUT NOT LIMITED TO, GOVERNMENT RESTRICTIONS, NATURAL DISASTERS, TERRORIST ACTS, WARS, RIOTS, STRIKES, AND OTHER ACTS OF GOD. IN NO EVENT WILL YOU BRING ANY ACTION AGAINST iHB MORE THAN ONE (1) MONTH AFTER SUCH CAUSE OF ACTION ARISES. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
9. MISCELLANEOUS.
You are only an Independent Client of iHB, NOT an employee or an associated contractor or an agent. Client can add multiple property/business by paying additional fees. Every client will pay additional fee if he/she wants to add multiple property/business on our website. In case of adding multiple properties/business iHotelBay will not charge only activation fee for other properties/business. Also, client must agree with all terms and condition mentioned above. We are not responsible if you are out of business, change the business, merger, expansion, partnership, change the ownership of the business, and/or start of new business or franchise.
All Disputes Shall be Settled by iHotelBay Officers only. In the event of a dispute between you and iHB, shall be submitted first to info@ihotelbay.com or ibusiness@ihotelbay.com and shall be submitted to final binding arbitration to be conducted in Gujarat, India. This location is chosen because the main office is located there.
These Terms and Conditions Are Our Entire Agreement. iHB prepared these terms and conditions based on all associated travel, hotels, restaurants, and/or other business listing related partners and associates. These Terms and Conditions, subject to amendment from time to time, represent the entire understanding and agreement between you and iHB with respect to the subject matter of the same, and supersede all other negotiations, understandings and representations (if any) made by and between you and iHB.
THESE TERMS, THE PROGRAM AND PRICING ARE SUBJECTED TO CHANGE WITHOUT PRIOR NOTICE. We are not responsible for any offers, coupons, deals, or promotions mentioned on your website. Individual business has all rights to reject the offers, coupons, deals, or promotions. We are not responsible for any failure to update the contents on our website.
